Amazon released its previously
announced Public Data Sets web
service this evening. The project encourages developers, researchers, universities and businesses
to upload large (non-confidential) data sets to Amazon - things like census data, genomes, etc. -
and then let others integrated that data into their own AWS applications.
Previously, Amazon says, large data sets like the Human Genome or U.S. Census data required
“many hours to located, download and customize,” but that developers can now access
and start computing on this data within minutes. Data is hosted for free.
Data sets available today include an Annotated Human Genome, a public database of chemical
structures, various census data and labor statistics.
Public Data Sets on AWS provides a centralized repository of public data sets that can be
seamlessly integrated into AWS cloud-based applications. AWS is hosting the public data sets at
no charge for the community, and like all AWS services, users pay only for the compute and
storage they use for their own applications. An initial list of data sets is already available,
and more will be added soon.
Previously, large data sets such as the mapping of the Human Genome and the US Census data
required hours or days to locate, download, customize, and analyze. Now, anyone can access these
data sets from their Amazon Elastic Compute Cloud (Amazon EC2) instances and start computing on
the data within minutes. Users can also leverage the entire AWS ecosystem and easily collaborate
with other AWS users. For example, users can produce or use prebuilt server images with tools and
applications to analyze the data sets. By hosting this important and useful data with
cost-efficient services such as Amazon EC2, AWS hopes to provide researchers across a variety of
disciplines and industries with tools to enable more innovation, more quickly.
There are other for-profit projects that are trying to help people tap into large public data
sets. San Francisco-based Swivel is one that
launched
in late 2006.
Perhaps someone can now upload all those now-public
iFund applications to Amazon.

Le rapport Varinard visant à refonder
l’ordonnance du 2 février 1945 est donc public après avoir été
remis officiellement à la Mme Garde des Sceaux. Foin des fuites ingénieusement
distillées depuis quelques jours pour créer l’ambiance et tenir en haleine.
Chacun le lira et pourra tenter de se faire sa religion. N’en ayant pas été
destinataire avant la date je vais prendre le temps de le découvrir pour me contenter
aujourd’hui de quelques observations générales.

En effet à la lecture des 70 préconisations avancée semble-t-il le plus
souvent à une majorité pondérée et de leur argumentaire on peut
d’ores et déjà se faire une opinion et essayer de décrypter ce rapport
imposant que la ministre qui vient de le recevoir ce midi n’a pas hésité
à qualifier elle-même de document de bon sens.

Je ne reviendrai pas sur ce qui justifiait la commande ministérielle. Dans trois posts
récents (281, 282, 284) et dans bien d’autres précédents je
démontrais que de mon point de vue rien ne justifiait une reforme fondamentale :
Â
1° Parce que la délinquance n’a pas mué en qualité ni cru
en quantité - elle est même en baisse de puis 2001 si l’on en croit les
statistiques du ministère de l’intérieur publiées dans le Monde du 27
novembre 2008 - au point qu’il faille bouleverser notre architecture juridique et
judiciaire.

2° Parce que rien ne démontre que la justice depuis 20 ans ait failli devant la
tâche. Elle a su innover dès 1992 avant mêmes les politiques. La loi est venue
ensuite cautionner ses différentes démarches pour répondre plus vite et plus
sûrement quand elle était accusée de se désintéressée de
la sécurité de nos concitoyens. Mieux elle a su être plus ferme et ne pas
hésiter à recourir aux moyens répressifs et coercitifs qui lui offrait la
loi : en 2006 sur 75 000 condamnations à l’encontre d’enfants
délinquants, plus de 6 000 peines de prison ferme, 15 000 peines de prison avec sursis
simples ou sursis mises à l’épreuve, 4 000 amendes, 5 000 TIG.
L’exception prévue à l’article 2 de l’ordonnance de 1945 a bon

3° Parce que la loi a été régulièrement adaptée et
remise au goût du jour en n’hésitant pas à introduire des innovations
qui portent atteinte aux grands principes de 1945 : le flagrant délit pour les mineurs est
possible, le parquet devient juge sous contrôle du juge; on a créé des
centres éducatifs fermés qui le sont sans l’être, etc. Si la
première édition du droit pénal des mineurs moderne est de 1945, ce
n’est pas un texte suranné, loin de là, pas plus que le code civil ne peut
être taxe de ringard pour avoir été publié en 1804 tellement il a
été revu depuis deux siècles. L’ordonnance a encore été
enrichie 5 fois en 5 ans entre 2002 et 2007.

4° Parce qu’enfin c’est ne voir que d’un Å“il que de
s’attacher à la prévention de la récidive quand il faut aussi dans le
même temps s’attaquer la prévention de la primo délinquance. Et
là tout reste à faire. Il est même risible de voir le
délégué de l’UMP prôner le dépistage des enfants de 3 ans
violents quand son gouvernement tord le cou aux RASED qui doivent justement venir en aide aux
jeunes enfants présentant des handicaps.
J’ai dis combien les réponses apportées en plein ou en creux à ces
questions démontraient que la motivation était idéologique et très
politique. On a une certaine idée de la délinquance et du contrôle social des
populations les plus fragiles ; on veut faire passer la justice pour responsable du
problème de l’insécurité pour détourner des vraies
responsabilités. Pour cela on n’hésite pas à adopter ce que j’ai
qualifié de démarche scientiste sur les données; et on jette
l’opprobre sur les professionnels. Je ne reviendrai pas sur ces points car il faut
s’arrêter sur les propositions Varinard et la philosophie qui l’anime.

On a déjà beaucoup disserté sur la mesure phare qui veut que l’on
pourrait condamner à la prison des enfants criminels dès 12 ans. On peut
difficilement parler d’avancée. J’observe que déjà Christine
Boutin membre du gouvernement que je tenais pour avoir une fibre sociale se démarque de
cette idée. Elle n’a pas été assistante sociale pour rien et ne
s’est pas penchée sur les prisons en vain. François Bayrou aussi est
monté rapidement au front. Les premiers propos de représentants du PS qui en a fini
de compter et recompter ne sont pas fracassantes et ne semblent pas laisser à penser
qu’il saura avoir un discours autre que populiste sur les reposes à la
délinquance. Attendons quand même tellement ce point symbolique est essentiel.

A chaud 5 remarques me viennent immédiatement à l’esprit :
Â
1 Tout d’abord je suis surpris de la référence permanence dans ce rapport au
placement avec une présentation idéaliste de cette prise en charge. Comme
s’il suffisait de mettre un jeune dans établissement dit éducatif pour que le
problème soit réglé, mais là n’est pas encore le plus grave :
on présente le”placement” comme une sanction ce qui de l’avis de
spécialistes est le meilleur moyen de faire échouer. Non seulement un foyer
n’est pas une machine à rééduquer, mais les jeunes ne s’y
trompent pas : ils feront tout pour faire échouer un foyer présenté comme
une punition. Ils préféreront la prison. Je l’ai vécu 1000 fois :
chaque fois que je “vends” à un jeune d’aller en internat scolaire et
qu’un éducateur parle dans mon cabinet de “placement” le jeune se
rétracte comme d’ailleurs ses parents.

2° remarque de principe : substituer le mot “mineur” au mot
“enfant” - juge de mineurs, tribunal pour mineurs et tout le long du texte - revient
à nier que des mineurs sont d’abord des enfants. Cette idée qu’avait
rejetée le gouvernement Villepin est hautement symbolique de la régression que
notre pays vit. Qu’on le veuille ou qu’on le refuse, en droit français et en
droit international - nous avons ratifié la convention internationale des droit de
l’enfant - , une personne de moins de 18 ans est un enfant. En vérité, on
veut lutter contre la compassion qu’inspire les enfants : ce ne sont pas des enfants.
Sont-ce même encore pour certains des êtres humains ? Ce sont des mineurs, des
personnes de moindre intérêt.

3° remarque : il est intéressant que ce texte qui se veut
révolutionnaire se raccroche explicitement en les listant à tous les principes de
l’ordonnance du 2 février 1945 (priorité éducative, focalisation sur
la personne, défense obligatoire, mobilisation des parents, etc.). On chercherait en vain
la rupture idéologique brutale. Ce qui fait déjà dire à certains que
somme toute on a échappé au pire. Pourtant tout le travail n’a pas
été fait pour rien. Quand on regarde de près toute les mesures entrent dans
le schéma de la répression et de l’autorité, seules choses
qu’entendraient les enfants - je maintiens qu’il s’agit d’enfants- : les
mesures éducatives sont remplacées par des sanctions éducatives et on a donc
le choix entre les sanctions douces (éducatives) et les sanctions fortes (prison, amende,
TIG).

4° : on a tellement peu confiance dans les magistrats et les travailleurs sociaux qui,
dans la représentation populaire, négligent les enfants délinquants que dans
la nouvelle procédure on pose sans arrêt des obligations et des contraintes de
délais. Résultat demain les juges ne pourront plus tricoter l’habit sur
mesure qu’impose une situation qui s’est dégradée depuis des
années. Comme si l’on obligeait les médecins à guérir dans des
délais pré-décidés et en plus en leur limitant les moyens
thérapeutiques. On va dans le mur.

5 et dernière remarque : On aura relevé qu’ a priori, avant 12 ans on ne
pourra plus engager de poursuites pénales contre un enfant quand aujourd’hui la
barre est à 7-8 ans,, quoique des exceptions soient semble-il prévues. Il reviendra
donc aux maires de traiter ces cas avec les Conseil locaux de prévention de la
délinquance et de la sécurité. Eventuellement avec l’appui de
l’Aide sociale à l’enfance et les structures contenantes dont elle devra se
doter. Les présidents des conseils généraux vont apprécier.
Imagine-t-on ce que cela aurait pu donner à Marignane ou dans telle autre ville frontiste
si le maire avait pu mener une politique de répression contre les jeunes de ses quartiers
difficiles ? On s’oriente bien vers une réponse à l’américaine.

Je reviendrai rapidement sur les mesures techniques, mais le débat politique va être
rude. Â

What It Is
St. Petersburg Times' Neighborhood Watch is a
database application that tracks weekly house sales in Pinellas and Pasco counties, Florida.
Readers can search for home sales by county, ZIP code or neighborhood. Median price and sale
count trends are tracked and graphed at one year, six month, three month, and one month
intervals. On a neighborhood level, the site plots geographical data on Google Maps and suggests
listings to prospective buyers by ZIP code. The application also generates
neighborhood-by-neighborhood trend stories by querying the database. The Times plans to expand
Neighborhood Watch to cover more counties in the future.
Why It's Innovative
Every paper has to do these kinds of real estate stories once or twice a year: The housing market
has gone up, it's gone down, it stayed the same, etc. It's not big journalism, but it is
important to the community and it takes a lot of time and resources to put together individual
stories for different neighborhoods.
Neighborhood Watch not only provides weekly data on the housing market, but includes an instant
story for each neighborhood -- a computer program analyzes sale trends to generate a short
synopsis of a neighborhood's market.
This frees up real estate reporters to focus on bigger stories with context and depth. Given the
current state of the market, freeing up a reporter's time to work on big stories is becoming more
and more important.
The data is even appearing in the print St. Petersburg Times neighborhood sections; the paper has
begun to reverse publish information that originally appeared on the web.
Who's Behind It
Matt Waite, the St. Petersburg Times News Technologist, is the brains behind Neighborhood
Watch.
A Django evangelist and data hound, Waite worked as a reporter for the St. Petersburg Times for
almost eight years. He is also the mastermind behind PolitiFact, a popular site where statements from
U.S. presidential candidates were fact-checked and rated (including the "Pants on Fire" logo for
worst offenders).
In 2004, Waite created maps to compare prices while he was house-hunting; those maps eventually
became the seed for Neighborhood Watch.
Waite explained that even though newspapers only have the time and resources to cover broad,
flashy stories, it was really the small, local details that interested readers. The same is true
in regards to real estate stories:
I give this speech at various journalism conferences about crime. There are two crimes I care
about: There's the crazy dude with the machete who hacks his ex-girlfriend's new boyfriend's head
off and mounts it to his car and waits for the police to show up; and my neighbor's lawn mower
getting stolen out of his garage.One of those you'll find in the pages of the newspaper,
guaranteed, the other is the opposite: you'll never, ever, in a million years read about my
neighbor's lawn mower getting stolen out of his garage in the pages of the St. Petersburg Times.
But I and my other neighbors were very interested when that happened. So the trick is to find a way
