Grâce à un documentaire, bientôt en salle, le cinéaste Roman Polanski qui depuis 30 ans risque la prison pour détournement de mineur, peut enfin espérer que la justice californienne abandonne les poursuites contre lui. « Roman Polanski : wanted and desired »: un documentaire sur les mésaventures judiciaires du sulfureux Roman Polanski, signé par la réalisatrice Marina Zenovich, vient de redonner espoir au cinéaste. Voilà trente ans qu’il n’a pas pu retourner aux Etats-Unis, pas même quand il a reçu en 2003 l’oscar du meilleur réalisateur pour son film « Le Pianiste ».  Car s’il foule le sol américain, il risque d’être envoyé directement derrière les barreaux.

Accusé de détournement de mineur sur une jeune femme de 13 ans au début des années soixante-dix, Roman Polanski, qui avait plaidé coupable, a été contraint de s’exiler précipitamment en France pour éviter la prison. Voilà l’affaire,  telle que l’histoire l’a retenue, jusqu’ici. Mais elle pourrait bien avoir une fin, grâce au coup de pouce d’un documentaire.

De fait, si à aucun moment l’auteur Marina Zenovich ne remet en cause la fiabilité du témoignage de la jeune fille, elle porte par contre un sérieux coup à la crédibilité du magistrat qui a instruit le dossier. Avec les témoignages accablants de la défense comme de l’accusation, la réalisatrice apporte la preuve que le juge J. Rittenband n’avait qu’une idée en tête: se construire une notoriété grâce à la publicité faite autour du procès. Le film explique comment il a tout bonnement franchi les limites de la légalité.

Ainsi, fort de ces nouvelles preuves, Roman Polanski aujourd’hui âgé de 75 ans a décidé d’en finir une bonne fois pour toute. Mardi dernier, par l’intermédiaire de ses avocats, il a demandé à la justice californienne d’abandonner les poursuites, histoire, sans doute de retrouver la paix.

We all know the triumphs and struggles of Roman Polanski, and how one of the latter has remained a thorn in his side to this day -- the sex he had with a 13-year-old girl 31 years ago. The recent documentary Roman Polanski: Wanted and Desired (which Erik and Christopher both reviewed) covered the years Polanski has spent avoiding jail and both the US and UK, and ended with word that it could have all come to an end, but that the judge wanted the proceedings televised. That was the end of that until now; Polanski wants it all done with.

The Hollywood Reporter posts that the famed filmmaker has filed papers with the Los Angeles Superior Court requesting that the case against him be dismissed. His reasoning, according to THR: "They list a slew of reasons for the case to be dismissed, including that the victim, Samantha Geimer, has made 'numerous' and repeated requests that the case be dismissed and that Mr. Polanski serve no further term of incarceration, a request that must be considered."

I can't help but wonder: Would Polanski really want to come back? Think about it -- the US he remembers isn't the US of today. I can imagine him coming back, seeing that nothing is as he left it all that time ago, and head right back to Europe. But this all also depends on whether they'll consider wiping it all away without Polanski being present. Think he'll risk it and finally hit US shores again?

Attorneys for Oscar-winning film director Roman Polanski are asking a California court to dismiss a 30-year-old sex offense case against him, claiming prosecutorial and judicial misconduct.

Lawyers representing Roman Polanski have asked a California judge to dismiss the statutory rape case against him because of evidence presented in Roman Polanski: Wanted and Desired, a documentary about the case, that the judge in the original case engaged in unethical and unlawful behavior.

Tuesday's filing said Judge Rittenband, who is now dead, intentionally violated a plea agreement with Mr. Polanski after having engaged in what it called "repeated unethical and unlawful ex parte communications" with a deputy district attorney who was not involved in the prosecution, but was independently advising the judge.

The request alleged that the film, which had its premiere in Cannes last May, revealed "a pattern of misconduct and improper communications" between the district attorney's office and the judge handling Polanski's case. /pp"This case serves as a classic example of how our justice system can be abused, and defendants' rights trampled, by an unholy alliance between courts and criminal prosecutors," said a statement from Polanski's lawyers, Chad Hummel and Brad Dalton. Dalton is the son of Doug Dalton, who represented the Polish-born director in the original case./ppPolanski, 75, has been living in Paris since fleeing the US to avoid a likely custodial sentence. He was originally indicted on six felony counts although all but one - unlawful sexual intercourse with a minor - were dropped. Even so, the film-maker faced a prison sentence of between 16 months and three years. The warrant issued at the time of his arrest remains in force, ensuring he would be seized by the authorities if he returned to America. /ppThe incident, which sparked a media storm, reportedly took place after Polanski booked 13-year-old Samantha Gailey as a model for a Vogue photo shoot. He is alleged to have given her champagne and Quaaludes (a sedative) before having sex with her at the Mulholland Drive home of his friend Jack Nicholson. Gailey publicly forgave the director in 1997. /ppAt the time of the incident, Polanski was one of Hollywood's most in-demand directors, thanks to the success of Rosemary's Baby and Chinatown. Despite his tarnished reputation, he continues to be well-regarded within the industry and won the 2003 best director Oscar for his work on the Holocaust drama The Pianist.
