32 min: That early goal seems to have sapped Arsenal's sense of urgency, and
West Ham have been reasonably comfortable in defence for the last 10 minutes. Both side's are
strolling a little, to be honest.
30 min: Brian McCloskey is wondering "how many boo-kings will there be?" Which
is certainly a better effort than Christian Wulff's "Fabreghast". Eboue plants a stud on Kovac's
knee, but it appeared to be accidental.
28 min: A hairy moment for the home side. Diamanti gets in behind Eboue and,
with Campbell and Vermaelen backpedalling furiously, elects not to shoot, rather tries to find
Franco, a decision which allows Clichy to nip in front and clear. Could have a been a real
chance, that.
26 min: Valon Behrami fouls Fabregas from behind and the resultant free-kick is
cleared from the vicinity of Sol Campbell's head by Mido. From the resultant corner West Ham
break, but Nasri fouls Kovac and play is halted again.
25 min: West Ham briefly put their foot on the ball and start to knock it around
in midfield, only for Fabregas to pinch it back. Arsenal hoard possession like your dad does the
remote. Bendtner is then nearly slipped through one-on-one – but he's offside.
23 min: Oh yes, I think we may have started something here. "Hey Alan, how many
ghouls do you think Arsenal will score today?" tee-hees Mike.
22 min: Arsenal then conjur another silken move, a series of one-touch passes
culminating in Bendtner nutmegging James Tomkins but putting slightly too much on it for Nasri to
be able to latch on to the ball.
21 min: Eboue, whose reputation has been remarkably rehabilitated this year,
daintily picks a path towards the West Ham box before curling a low effort wide.
20 min: It's quietened down a little, Arsenal merely probing gently rather than
trying to tear the Hammers a new one. You fancy they'll give West Ham at least a couple of
chances at some point, though. Song dispossess Mido magnificently and then wins the foul himself.
17 min: Nasri is back on, but Fabregas is almost immediately down, clutching at
his leg after Kovac's tackle from behind. No need to worry, he seems all right.
15 min: Speaking of Spector and the like, Arshavin ghosts (yep, I did) past the
West Ham right-back and his cross nearly finds Bendtner. Diamanti then releases Franco into the
Arsenal half and his ball to the back post is just too heavy for Mido.
14 min: Bad puns? We love 'em. "I like the fact that Spector plays for the team
that Martin Peters used to ghost in for, ten years ahead of his time. And Mido is a bit of a
zombie too." B'dum tish, I believe is the response. Thank you, Gary Naylor.
13 min: Nasri is on his knees after attempting to tackle Mido and injuring
himself in the process. Mido and Zola then have what looks like a frank exchange of views on the
touchline. Nasri limps off for treatment.
11 min: Arsenal are weaving their web delicately around the edge of the Hammers'
box. Nasri is almost played in on goal again after his flick found Fabregas and the Spaniard
attempted to play it back into Nasri's path, but the ball runs out for a goal kick.
9 min: Song breaks up play and launches Arsenal on to the attack with Emmanuel
Eboue. His ball into the middle is chested down by Bendtner to Fabregas, who finds Nasri and the
Frenchman dinks a delightful pass over the West Ham backline for Denilson. The Brazilian doesn't
connect properly this time, however, his volley bouncing tamely into Green's grasp.
8 min: Alessandro Diamanti lines up his first free-kick of the evening, and hits
it well, the ball rising and falling over the wall but not quite coming down enough. Almunia had
to go for it though.
6 min: Look like this could be a very open one. Bendtner comes in from the left
and isn't closed down, the Dane spanking a low effort which swerves past Green's right stick.
GOAL! Arsenal 1-0 West Ham (Denilson 5) That's why the Brazilian starting! West
Ham failed to clear properly, allowing Denilson to exchange passes with Nicklas Bendtner before
striking a sweet shot with his laces into the bottom right-hand corner, past Robert Green's
despairing dive.
3 min: Franco is unable to control the ball on teh edge of the Arsenal box after
Kovac's centre. Almunia clears up. "Why would you assume that those reading your commentary would
have forsaken a night at the pub? I'm at my local, reading your ramblings, and the cute waitress
just brought a lit candle to my table saying that 'she thought I might like a nice romantic
evening with my laptop'. The game, and your commentary, better be worth all this ridicule, Alan."

1 min: Ask Andrey Arshavin and Gael Clichy combine down the left, and the French
left-back's cross finds Samir Nasri on the far side of the box. He's quickly crowded out, though.
Peep! We're off and Junior Stanislas goes sprinting off down the left wing,
slicing deep into Arsenal territory. He's hustled out by Alex Song and Cesc Fabregas and Arsenal
win the throw-in.
The teams are out. My West Ham supporting colleague Jacob Steinberg says: "No
Parker, no hope."

picture of Aaron Ramsey emblazoned on a giant flag fluttering in the breeze. They certainly seem
to have coped better with the Ramsey incident better than they did with Eduardo two years ago.
5.22pm: Shaka Hislop is predicting an Arsenal win; Kevin Keegan, touchingly,
fears for West Ham. The Gunners will go top if they win, of course, if only for the best part of
24 hours. Here's some more Arshavin wisdom:

Arshavin: I disapprove of it.
Good afternoon, USA: "It's actually a bright 1:30 kick-off here in the US, and
I'm watching it in the comfort of my home," says Aidan Gibson. "Any ideas why Denilson gets the
start ahead of Diaby? The only reason I can think of is his 30-yard strikes, including the one
that assisted Bendtner's winner last weekend." I think it's probably an example of squad rotation
– Denilson is fairly fresh and Nasri and Fabregas will be given a bit more
freedom with the Brazilian sitting deep.
5.10pm: So, West Ham are without injured captain Scott Parker and have Carlton
Cole, who is presumably being nursed through with an eye on the Hammers' next home game, against
Wolves, on the bench. Arsenal rest Bacary Sagna, starting with Emmanuel Eboue at right-back, and
have Cesc Fabregas back after two games out with a hamstring injury. Sol Campbell, partnering
Thomas Vermaelen in defence, will be hoping that Mido and Guillermo Franco don't give him the
sort of Harewood-Zamora working over that saw him hauled off at half-time (for Sebastian Larsson,
no less) the last time he played in this fixture.

Anyway, to the football. West Ham have a decent record at Arsenal in recent seasons, winning one
(thanks to this little Bobby Zamora
number), drawing one and losing one from three visits to the Emirates; and they were also the
last team to win at Highbury, on the night Sol Campbell had his infamous 'mare.
Against that, Arsenal have won five in a row in the league, dragging their fragile title
challenge along in the wake of Manchester United and Chelsea. They have also won six of their
seven Saturday 5.30pm kick-offs, scoring 20 goals in the process (the one loss? 2-1 at Old
Trafford in August). So where's your money? It's going to be a home win, isn't it ...?

Rick
Astley is preparing for a 2010 80's music tour. Astley will be heading a revival concert at the
opening of the Open Air Theatre of Scarborough on July 31 with artists such as Boy George,
Paul
Young and Kid Creole and the Coconut. Other acts are Nik Kershaw,
Midge Ure,
Heaven 17,
T'Pau, Hazel
O'Connor and Toyah. All of them have scored a combined total of 70 Top Ten Hits.
There will be at least four more tour dates according to Rick Astley's website.
Rick Astley became famous in the eighties when his first single, Never Gonna Give You Up, achieved number one on the United
Kingdom and United States charts. Subsequently he released several other successful singles
including Whenever You Need Somebody,
Together Forever. He retired from music in 1993, after
releasing his album, Body and Soul. Astley did a
comeback in 2001, with the release of Keep
It Turned On, and in 2005, Portrait. In 2007, Rick Astley unexpectedly became
famous on the Internet, when the rickrolling meme was
born. In 2008 and 2009, he took part in the nostalgia tour, Here & Now, visiting
countries such as the Philipines, Chile and the Dominican Republic.

In the last few years, there's been a push by some companies to bring back the immensely troubling
"hot news doctrine," that appears to violate everything we know about the First Amendment and
copyright law. Basically, the "hot news doctrine" says that if someone reports on a story, others
are not allowed to report on their reporting for some period of time -- on the theory that it
somehow undermines the incentive to do that original reporting. Last year, we wrote about the
very troubling
implications of allowing the hot news concept to stand. Beyond the free speech implications, it
also has the troubling quality of effectively creating a copyright on facts -- which are quite
clearly not covered by copyright. On top of that, it's not necessary in the slightest. As anyone
who is actually in the online news business knows, getting a scoop gets you traffic -- even if
others report the same thing minutes later. Being first gets you the attention. You don't need to
artificially block others from reporting the news.
Unfortunately, with various publications struggling, some have picked up on the hot news doctrine
as a way to somehow block competition. Tragically, it looks like a court has now adopted the hot
news doctrine in one case. Paul Alan
Levy alerts us to the news that a judge issuing an
injunction against TheFlyOnTheWall.com, a website that would publish summaries of Wall Street
research. The Wall Street firms said this undermined their business model -- and the court agreed.
It passed an injunction saying that TheFlyOnTheWall had to hold off publishing any news about any
Wall Street research report until either 10am (if the report is released early in the morning) or
for two hours after it's released if it comes out during the day.
These totally arbitrary restrictions are highly troubling from a free speech standpoint and seem
effectively random. This seems like yet another case of a company being upset by interference with its business model,
which should be a reason to change the business model -- not run to the courts.
But what's most troubling of all is that now all the publishers who have been salivating over the
hot news doctrine have a legal ruling to point to. Can you imagine how the world would work if you
couldn't blog about or mention a particular piece of news for a few hours because the Associated
Press got to it first? It's hard to see how this could possibly stand up to a First Amendment
analysis, and it's quite troubling that the judge found the way she did.

written Dope Stories, and the upcoming Tripping. He has a show on YouTube, and in the words of Rhys Ifans,
"He's a folk hero in the UK, but in Wales, he's a hero."
So how do you turn a book about a (folk) hero into a film? Director Bernard Rose
( Candyman, Immortal Beloved, ivansxtc) has attempted to do it with a
mixture of different styles, archival stock footage, and performances from Rhys Ifans and Chloe
Sevigny. Ifans might not be the first name that jumps to mind when you think historical figure, but
just watch that YouTube footage above and you'll see why they went with Ifans. It would be either
down to him or Geoffrey Rush. Since Ifans is Welsh, just like Marks, and had a history with the
man, that casting made a lot more sense.

Media Matters for America -

You know those special
amps used by Spinal Tap that go to 11, in order to provide "that extra push over the cliff"?
It appears Fox News has gotten a hold of some and hooked them up to its coverage of health care
reform.
As the reform bill moved closer to a vote in the House, the Fox News noise machine went into
overdrive, hurling every false and misleading claim it could muster.
The week in Fox News health care hysteria began with an oldie-but-goodie -- Steve Doocy, Bill Hemmer, and Bill O'Reilly all claimed or suggested that
the bill will, in O'Reilly's words, "require American taxpayers to fund abortion." But it
doesn't, at least not beyond what is currently permitted under current law. Fox News,
unfortunately, is not alone in
repeating this falsehood.
Then, Doocy and Hemmer, joined by Neil Cavuto and several other hosts, jumped on the idea that
a legislative procedure the House is reportedly considering to pass the Senate's version of
health care reform would allow them to do so without a vote. Wrong again -- the House would need
to vote to implement that procedure.
Carl Cameron, however, broke through the noise on this issue, pointing out that the process would simply
pass the bill "in one vote instead of two" and that the process "has been used, literally, for
centuries" -- indeed, Republicans made
copious use of the "self-executing rule" when they controlled Congress. Even Charles
Krauthammer conceded that it's
constitutional. Still, that didn't keep Alisyn Camerota from scoffing that the rule "might as well be a
self-immolating rule."
Fox News then pounced on a survey
claiming to have found that 46 percent of primary care physicians would consider leaving their
profession if health care reform passes. O'Reilly, Sean Hannity, and contributor Dr. Marc Siegel
all portrayed the survey as having been published by the prestigious New England Journal of
Medicine.
Except it wasn't. The article was written by the physician-recruiting firm that conducted the
survey, and it actually appeared in an employment newsletter produced by the publisher of the
New England Journal of Medicine, not the Journal itself. Further, the survey
itself was not all that scientific -- done via email contacts taken from the recruiting firm's
database -- so any claim that the survey's results accurately reflect the view of the American
medical community is dubious at best.
Fox News' Megyn Kelly did eventually note
that the survey was "not a scientific poll." But that didn't keep Glenn Beck from insisting -- hours after Kelly corrected the
record -- that "The New England Journal of Medicine says that if this bill is
passed nearly one-third of doctors will quit practice medicine."
(Beck, meanwhile, is keeping up the long
tradition of Fox News hosts pushing partisan political agendas by joining with Republican
Rep. Steve King to promote an anti-reform rally in Washington.)
Fox News contributor and serial
misleader Dana Perino made her own non-contribution to the health care debate, asserting that the reform bill's Medicare
investment tax on those making over $200,000 a year is "so disturbing ... because the people who
make that money are the small business owners." In fact, fewer than 1.3 percent of small business
owners would be affected by the tax.
When the Congressional Budget Office released new numbers detailing how the reform bill would
reduce the deficit by $130 billion over 10 years, Fox News didn't want to talk about that -- it
spent far more time highlighting how
much the bill would cost instead of how much it would save. And when that didn't seem to work, it
tried to discredit the CBO as
untrustworthy and unreliable. Never mind that when the CBO issued "favorable" numbers last fall
on a Republican health care reform plan, Fox News praised the CBO as "nonpartisan."
The Fox News spin is even confusing its own hosts. Brian Kilmeade can't quite comprehend how a bill can cost money
yet reduce the deficit, and Kelly admitted, "I don't understand anything they're
talking about when it comes to this potential law."
Fox News' inept war against health care reform, while in keeping with its function as the
communications arm of the Republican
Party in exile, is making itself look like the Spinal Tap of news. It doesn't really need that
"extra push over the cliff" -- after all, that's what it's been speeding toward for years.
At this rate, it probably won't be too long before a Fox anchor
spontaneously combusts.

A whole lot of shaky earthquake claims goin' on at Fox
How much does Fox News oppose health care reform? It's pretending natural disasters didn't happen
if they're inconvenient to the anti-reform agenda.
On March 18, Doocy took exception to
President Obama's statement that a provision in the health care reform that would help Louisiana
cope with Medicaid shortfalls resulting from Hurricane Katrina might also help Hawaii because it
"went through an earthquake. "Hold it. What Hawaiian earthquake?" Doocy asked. "There was an
earthquake in 1868 that killed 77. There was an earthquake in 1975 that killed two." After noting
that the provision applies to states that have suffered a natural disaster "within the last seven
fiscal years," Doocy added: "Essentially it boils down to just one state, and that is Louisiana."
Doocy seems to have forgotten that there was an
earthquake in Hawaii in 2006. Not only did it cause tens of millions of dollars in damage,
the
Bush administration "declared a major disaster exists in the State of Hawaii and ordered
Federal aid to supplement State and local recovery efforts" as a result of the quake.
But Doocy didn't need to rely on federal agencies for information on the quake -- Fox News
reported on it at the time.
(Investor's Business Daily similarly
ignored its own reporting to suggest there was no recent Hawaii quake.)
It seems that rather than trust the federal government or his own news organization, Doocy chose
instead to trust right-wing bloggers, who were spreading the misinformation. That runs
counter to a 2007
memo -- issued after Doocy and other Fox hosts falsely claimed that Obama was educated in a
madrassa -- in which Fox News vice president John Moody reportedly wrote, "For the record: seeing
an item on a website does not mean it is right. Nor does it mean it is ready for air on FNC."
Media Matters has written
Fox News requesting that Doocy correct the record. We shouldn't have to, since Fox News is
supposed to have a "zero tolerance" policy toward on-air mistakes, but then, these are the same
folks that
ludicrously insisted that a Fox & Friends graphic in which poll numbers added up to 120 percent contained no
errors.
The latest right-wing witch-hunt target: Jim Wallis
Fox News has long been a leader in witch hunts against Obama and his administration (or, really,
anyone who can be remotely tagged as liberal). Now Glenn Beck, as an extension of his repeated
challenged Beck to a debate over
social justice, Beck demurred, his vaguely
threatening statements making it clear his witch hunt was more important than reasoned
debate: "In my time, I will respond. ... Just know the hammer's coming. ... And when the hammer
comes, it's going to be hammering hard and all through the night, over and over."
Right-wing website WorldNetDaily, meanwhile, blundered into the breach with a poorly written
article that attempted to put words in Wallis' mouth. WND claimed that Wallis was a "champion of
communism," even though Wallis has declared communism to be a "failed" system; asserted that
Sojourners has published "a slew of radicals" while ignoring that it has also published a slew of
conservatives; and alleged that "Sojourners' official 'statement of faith' urges readers to
'refuse to accept [capitalist] structures and assumptions that normalize poverty and segregate
the world by class,' " even though the word "capitalist" -- inserted by WND -- actually appears
nowhere in the statement. WND even falsely claimed that Wallis "labeled the U.S.
'the great captor and destroyer of human life.' "
Somehow, we suspect that Beck's upcoming assault on Wallis will be just as divorced from reality
as WorldNetDaily's.
Erick Erickson joins the "scumbags" at CNN
Should a blogger who once called a retiring Supreme Court justice a "goat f---ing child molester"
be rewarded with a regular commentary gig on CNN? Doesn't matter -- the deal's been done.
CNN announced this week that RedState editor Erick Erickson has joined the network as a political
contributor, mainly appearing on John King's new show. The network claimed that Erickson is "a
perfect fit" for King's show, adding that "Erick is in touch with the very people John hopes to
reach."
Media Matters has detailed
Erickson's history of outrageous statements, of which the aforementioned is but one.
Predictably, conservatives defended
Erickson's new job, his fellow RedStaters among them. One of Erickson's RedState defenders,
however, went a tad off-message: "From
Non-Conservatives, to Academics and Liberal Elitists, to self-soiling and unprincipled
Professional Politicians and firmly-entrenched good ole boys inside the
M(ostly) S(cumbags)
M(edia), each of these clowns has a tale of doom about the
hell we're headed for compliments of CNN's hand basket."
We have to wonder: Does Erickson consider
his new CNN colleagues to be "scumbags"?

HiFi is the best rock'n'roll bar in NYC.The room
is covered with empty album sleeves and the juke box is hands-down the best in the city
– I believe there are about 3,000 albums on it, so you can't complain about
them not having your song. There is a fantastically affordable happy hour and a great local
crowd. Like the rest of the East Village, it can get a bit much on weekend nights, but most of
the time it's my favourite bar in town.

Pegu Club, New York
The entrance to the Pegu is an unassuming
doorway on the south side of West Houston Street. It's only when you are up the stairs that the
glory of this place hits you. It is like going back to the great clubs of the 20s, when the staff
were pretty and jazz and cocktails ruled. On a recent visit, two amazing Django Reinhardt-style
guitarists were swinging through 30s classics. Cocktails are taken seriously here
– the art of proper, classy drinking is almost a motto. At the weekend it can
get pretty busy as it is becoming the "in" place.

Po' Monkey's, Mississippi
It was a balmy night in September when I visited Po' Monkey's juke joint. It's a ramshackle hut
powered by a single cable in the tiny town of Merigold, deep in the Mississippi delta. A poster
on the door warned: "Bring your liquor inside but not your beer." The walls were cluttered with
posters and age-old postcards, while toy monkeys swung from the rafters. It was low lit
– smoky but inviting, with beer and whiskey flowing freely. Terry "Harmonica" Bean took to the tiny
stage, elbow to elbow with the crowd, and delivered a mind-blowing, foot-stamping performance
that will stay with me forever. Delicately soulful cries came from his ageing gruff voice, while
stupendous bluegrass melodies oozed effortlessly from his antique steel guitar. This was raw
blues at its authentic and spine-shivering best.

The Spirit Store, Ireland
The Spirit Store in Dundalk, County Louth, is
on the edge of town beside a small harbour. There's a small, friendly bar downstairs which opens
around 4pm, but it is the live music upstairs that is the main draw. You would be hard-pressed to
find anywhere as welcoming to an artist and more genuinely music-driven in its programming of
events. That's why I keep going back there to play, and why many other artists who have outgrown
the 120- or so capacity venue keep returning. So many venues and promoters are about the money
but Derek Turner, who books the music, is driven by something much more.

Not exactly a venue, not exactly a bar, entrance to Trishas/The Hideout/that door on
Greek St (as it is variously known), is obtained by boldly knocking on what appears to be the
entrance to a flat above a shop, striding through a starkly lit corridor and down a flight of
stairs, before mumbling an explanation to the owner as to why you don't appear to be in
possession of a membership card – having accidentally put it through the
washing machine normally does the trick. Inside, you'll find a cupboard-sized, candle-lit cavern
which can be hired out for private music showcases. But stumble in unannounced after hours on a
weekend and you might also find a doo wop or jazz band sandwiched into the corner between the
usual crowd of transvestites, metropolitan hipsters and veteran Italian locals.

The Shed North Yorkshire
I first played at this blink-and-you'll-miss-it shed in the tiny village of Brawby back in 1998.
It only held 64 people and we scraped our legs on the front row's knees. It has since moved to
Hovingham village hall, though it retains its name. The man behind The Shed, Simon Thackray, has
presented events from the Fish and Chip Van Tour with a trombonist, to mixed media knitting
installations – saxophonist Lol Coxhill playing free jazz in a skip to coach
trips for folks in knitted Elvis wigs touring sites of Elvisian interest in Ryedale. My own band,
Hank Wangford and the Lost Cowboys, started a tradition of Christmas gigs at The Shed, where we
play morose songs and have a riotously miserable time. The Shed was the inspiration for my
village hall tour around Britain, which I am currently writing up as a book. And, after 235
villages, The Shed is still the loony best.

For me, the greatest gig of 2009 was at A38, a
huge old ship that used to lug coal up and down the Danube. The lower deck is now a
state-of-the-art live music venue, but bits of engine room equipment are still there. Even though
the boat is held down in dry dock by 100 tonnes of concrete, the bottles still jingle on the
shelves of the bar when the parties get wild. The booking policy is great –
they've had cutting-edge electronic artists such as Ikonika, Dorian Concept and Foreign Beggars
play recently. And nothing compares with the signature dish of the restaurant on the upper deck:
rooster stew, complete with the crest and testicles of the bird.

Hobbs, Radio 1 DJ. Her show is broadcast on Thursdays 2-4am
Wild At Heart, Berlin
Wild At Heart is a
whisky-soaked, no-nonsense rock'n'roll joint in Berlin's old anarchist district, Kreuzberg: a
seven-nights-a-week venue painted blood red, crammed with Elvis memorabilia, Hawaiian gods and a
lifetime's supply of hard liquor. For 15 years it has presented bands from all over the world
– mostly punk, rockabilly, psychobilly, 60s garage and surf. I spent a
memorable evening there talking to TV Smith from the Adverts and another with Wreckless Eric,
both of whom started out with punk label Stiff Records in 1977, and I've played there with my
band, the Flaming Stars. The music's loud, but the welcome is friendly, and the club also runs
the Tiki Heart cafe and clothes shop next door,
where you can eat, drink and kit yourself out in a spectacular variety of rock'n'roll
clobber.

Max Décharné, singer in the Flaming Stars and author of A Rocket in My

Mesa de Frades, Lisbon
Mesa de Frades in Alfama, the oldest district of Lisbon, is the sort of place you dream of
hearing fado, the traditional soulful Portuguese music. A tiny converted chapel with
tiled walls, it is full of locals and quality performers booked by owner Pedro Castro, a great
guitar player. You can come for the music, which starts late – around 11pm
– or book a table and come for an excellent dinner beforehand. A couple of
years ago I sat here watching Carminho, the amazing young fado singer who is now the talk of
Lisbon. When the music starts, the doors are shut to enclose the tiny performing space. It's what
fado in Lisbon should be, but so rarely is.

Il Folk Club, Turin
In the heart of Turin, off Piazza Statuto, you'll find the best of all worlds: from Wednesday to
Saturday Il Folk Club plays host to Italian and
international jazz, folk and world musicians. How this Italian institution –
legendary in Turin for over 20 years – has remained generally unknown to
travellers and music junkies outside Italy is a mystery. Alongside its regular programme, Il Folk
Club is also the launching point for Radio Londra, a monthly mini-festival which fuses British
musicians such as Jim Mullen, Kit Downes, Brandon Allen and Quentin Collins Quartet, with local
stars such as Mario Pozza, Enzo Zirilli and Dado Moroni. The bar is simple –
one central room with space for about 150 people, exposed brick walls, and a stage
– so the focus is always on the incredible music.

Gerbard, Barcelona
This little neighbourhood bar used to have a green door with panes that rattled when you opened
it, but it has now been replaced with something more solid, partly to keep the sound in. It's run
by Mar and Nacho, both dyed-in-the-wool culés (Barcelona supporters), and nights
there are long and loud. You can hear Sam Lardner, an American resident who plays his own fusion
of flamenco and bossa nova, or wonderful classical and flamenco guitarists like Daniel Figueras
and Pedro Javier Hermosilla, or the Covers Project, with frontman Philip Stanton. The eating and
drinking are delicious too – Galician-style octopus, traditional meatballs,
pimientos de padron (small green peppers), and wine for not much more than a euro a
glass. A great night out in the Alta Zona.

La Casona del Molino, Salta, Argentina
Salta, in north-west Argentina, is well-known for its folk music heritage. This has given rise to
the creation of pena, which roughly translates as a place where musicians and music
lovers come together. Seven nights a week you can experience this at La Casona. The venue's five
colonial rooms are filled to the brim with musicians, professional and amateur, folk, jazz and
others, locals who come down from the Andes bearing pan pipes and drums, and some foreign
visitors, all coming together to jam the local tunes. As a musician, I found great comfort in the
fact that this kind of place exists in the world. And of course, many people come simply for the
music.

Salón Rosado de la Tropical, Havana
The first time I asked a taxi driver to take me to Havana's Salón Rosado de la Tropical
back in 1989 he said it was a place for Cubans, not foreign tourists – and
certainly not lone women – and I'd better watch out as it could be rough. He'd
obviously never been inside this mecca of Cuban dance music, where all the top bands play
regularly, testing their latest material in front of the sexiest dancers on the island. In Cuba,
most music venues are geared to tourists and too expensive for ordinary Cubans, who are often not
allowed in anyway. Not so the Salón Rosado. This is the closest you can get to hanging out
with a Cuban clientele. Dedicated to the memory of Beny Moré, Cuba's touchstone band
leader of the 1950s, it started out life a Spanish cultural centre at the beginning of the 20th
century. These days there's a balcony reserved for tourists overlooking the dance floor where, if
you're lucky, you may rub shoulders with the musicians as they gather for the gig. Although today
reggaeton and hip-hop dominate street tastes, Salon Rosado continues to offer a window on to the
latest music scene and is a dancer's dream.

Liquid Room, Tokyo
Leading Japanese venue Liquid Room has been going for about 15 years and hosts weekly bands and
DJs from Japan and around the world. The website may say it closes at 12, but the last time I
played there, as The Orb, they didn't let us out till 6am. There's a beautiful cafe upstairs and
the friendly enthusiasm of Tokyo clubbers has to be experienced to be believed. The last time I
played there I took a bag of Space Dust (the sweet!) which made me very popular.

New Africa Shrine, Lagos, Nigeria
Lagos is not your classic tourist destination; it's a prohibitively expensive city of 14 million
people and a crime record to frighten even the toughest traveller. But Nigeria's notorious
capital does have one musical landmark worth going the extra mile for: the New Africa Shrine. It's named after the
legendary club run by the late musical activist Fela Kuti, which was razed
by soldiers. Fela's daughter Yeni and her musician brother Femi have built up a nightclub that
can hold thousands and has live music throughout the week. It's not for the faint-hearted, but
the Shrine is probably the safest place in Lagos: it has its own police force. You'll get a warm
welcome, and hear some of the best live music in the region.

Last month we
wrote about Crocodoc, a new Y Combinator-funded company that makes it very easy to upload a
text document or PowerPoint deck and mark it up online to share with your colleagues.
Unfortunately, it was also pretty bare boned — you couldn’t
even save your edited document to your hard drive. Today, that’s changing: Crocodoc has
rolled out some key new features (including the ability to save) that make the service
significantly more flexible, and also pits it more directly against Adobe’s Acrobat Pro.
Aside from the ability to save to PDF, the new version includes a freehand pen tool, a tool to
convert any website to PDF (which you can then add notes to), and a new API. In a few days, the
company will be releasing its application on Google’s recently-launched App Marketplace. The service will
also be rolling out a Flash-based embeddable document viewer (similar to what you’ll find
on DocStoc and Scribd) that lets you both view and mark up embedded documents.
CEO Ryan Damico says that these features make Crocodoc more competitive with Adobe’s $400
Acrobat Pro software because the free Acrobat Reader most people have doesn’t allow them to
mark up and save their documents (personally, I’ve been avoiding any software with the word
‘Acrobat’ in its title for years). Damico does acknowledge that there are still
plenty of premium features that Crocodoc doesn’t have that Adobe’s paid
software does, but says that this basic editing/saving functionality is what most people are
after, anyway. Damico says that in the long term, Crocodoc is hoping to “do to
Acrobat what Gmail did to Outlook” by taking a widely used desktop application and bringing
it online.

A group of senior public figures have called on the government to abandon its plan to push
through controversial digital economy bill before the election, amid claims that the move could
"sidestep" the democratic process.
Earlier this week the government revealed that it wants to force the digital economy bill - which
includes the controversial "three
strikes" rule to cut off the internet connections of those accused of illegal file sharing -
into the statute books in the next few weeks.
While it usually takes far longer to create an act of parliament, thanks to the public debates
held by MPs, the secretary of state for business, Lord Mandelson, plans speed up the process by
making use of a controversial parliamentary technique known as the "wash-up".
Under those rules, party whips bypass the usual debating process and make a series of horse
trades in order to get proposals into law before parliament dissolves ahead of a general
election.
That proposal has already caused
concern, but today a coalition including a cross-party group of MPs and peers - as well as
figures from the business world and entertainment industry - said that short circuiting the
democratic process could have disastrous side effects.
In an open letter the group suggests that the controversial nature of the legislation - which it
says "threatens to severely infringe fundamental human rights" and could introduce "website
blocking" measure that impede free speech - must face the full scrutiny of parliament before it
becomes law.
Among the signatories are musician Billy Bragg, human rights activist Peter Tatchell and writer
Graham Linehan, who helped create comedy series including Father Ted and The IT Crowd. They are
joined by a number of activists and campaigners, as well as politicians drawn from Labour, the
Liberal Democrats and the Green Party.
"Our worry today is that none of this will be properly debated by parliament," says the letter.
"Last week Harriet Harman failed to give the Commons any reassurances that this important,
complex and controversial bill will be properly scrutinised by our elected MPs."
"Democracy and accountability will be sidestepped if this bill is rushed through and amended
without debate during the so-called 'wash-up' process. The thousands of people we know to be
contacting their MPs with concerns will find their faith in politicians even further undermined."
The plans,
which first became public last autumn, have caused controversy at almost every turn.
As well as the three strikes rule and measures to take down websites accused of infringing
copyright - which could
potentially result in the closure of major web destinations such as YouTube - Lord Mandelson
has also sought the power to alter copyright law without the assent of parliament.
In addition, it has also been suggested that the bill's measures to prosecute the owners of
internet connections used for illegal file sharing could
hit anybody who provides web access - such as universities, libraries and cafes, as well as
those individuals who leave their home Wi-Fi connections open.
While the made it through three readings in the House of Lords, it was not without serious
objections. Lord Puttnam, the film producer, said he had faced "an extraordinary
degree of lobbying" over the proposals, while others questioned the revelation that an
amendment used language British music industry body the BPI.
Earlier this week BPI chief Geoff Taylor said that it was imperative that the legislation is
passed before the election.
"It is vital for the future of the UK's creative sector that the digital economy bill becomes law
before the dissolution of parliament," he said.
However, the open letter suggests that the bill's most controversial elements must receive proper
debate or be removed from the bill entirely and left until after the forthcoming election.

About five years ago, I wrote a detailed report on how one could have the choice between GNU /
Linux and other operating systems in Argentina. that was most surprising for French people, that
have always had the greatest difficulties in getting such a choice, despite the remarkable
efforts made by the Working Group Detaxe
and Racketiciels. It was even possible at that time in
Argentina to compare on the website of major retail chains (Fravega, Garbarino, the equivalent of
Darty or Boulanger in France) the price for the same machine with another operating system or
with a Debian-based, customised Argentinian GNU / Linux, developed by an SME named Pixart (not to
be confused with the studio Pixar!).
But starting from 2 years ago, I have seen that it has become impossible to find any
longer a single machine with GNU / Linux in retail: worse, we saw some very
dubious agreements negotiated under the high patronage of the founder of the multinational
software company that monopolises the operating systems market.
One may well ask why: this is not without reminding us of the situation here in France, where
after SFR placed on the market more thatn 250000 Netbooks all equipped with GNU / Linux about two
years ago, we can not find now a single netbook without Windows (yes, I write the name in full
letters now, because I am particularly upset: I wanted to buy one for personal use this
Christmas, but despite my efforts, I have not found a single model with a GNU / Linux
preinstalled in France).
The few remaining fans of software monopolies like to say that this sudden vanishement proves
that the other operating system is superior to GNU / Linux.
Well, I happen to have in my hands right now a copy of the appeal filed against Microsoft by the
little Argentine SMEs Pixart, and it is very helpful in understanding what really happened there
... and very likely what is happening here too.
The Windows For The Poor
Microsoft does not usually sit back when it loses market share, and I already noticed back then
that Redmond had put in place a strategy to counter the spread of GNU / Linux in emerging
markets. In Argentina, already in 2005 they had managed to convince the government to spend
taxpayer money on an operation codenamed 'Mi PC', which through a microcredit whose interests
were paid by the state, encouraged the public to buy machines that are sold with Windows SE
(Starter Edition, they say), better known today as Windows FTP (For The Poor). This edition
sports ludicrous limitations like the following: only recognises 256 Mb of RAM (with XP, It's a
little short), 80 GB hard disk (ditto), screen resolution was limited to 800x600, no local
network, and you cannot open windows for more than 3 applications at once (oh well, if there is
something that poor people have in abundance is time, therefore they will only run 3 tasks in
parallel, and no more).
This version was sold cheaper than the standard Windows editions , with the aim to compete with
GNU / Linux machines, but at that time this move made me laugh quite a bit because the early
machines with Windows FTP still costed at least 500 pesos more than the equivalent GNU / Linux
systems, which had no such ridiculous limitations: one really had to be poor in spirit to
purchase them!
The rear margins (or Market Development Agreements)
What I did not know in 2006 is that the Windows For The Poor was just a first step in the
strategy: The second step was to artificially lower the final price of computers running Windows,
and financially strangling Pixart, which could not charge anymore its service for
pre-installation of custom GNU / Linux on machines manufactured in Argentina.
In reading the appeal filed by Pixart, we learn that Microsoft would have started in 2008 to give
back large amounts of money to the whole distribution chain to convince them to buy exclusively
Windows, and these sums have been disguised in various forms.
For example, I heard that Microsoft would have payed hundreds of thousands of dollars a year to
some distributors, officially for the Microsoft logo to appear on the leaflet advertising the
chain. Well, this kind of operation is called 'rear margin' here, and generally corresponds to an
abuse of dominant position from retailers who charge abusive fees to small suppliers for
purported advertising campaigns that hide forced rebates. But in our case, I have a hard time
thinking that a small retail chain in Latin America has a dominant position when facing a
multinational that generates profits of billions of dollars a year.
But why, you will say , is Microsoft complicatin its life like this? Was'nt it easier to simply
lower the cost of licensing Windows to, say, $ 5, rather than continue to charge $ 100 initially,
to repay $ 95 to distributors right after?
Well, no! Because, if we lower the cost of the officially licensed Windows FTP to $ 5, then it
must be sold $ 5 everywhere, and we can no longer pretend to charge $ 200 to large customers
(such as ministries in Argentina) for the full version .
It is much more interesting to pretend that the cost is 50 or 100 dollars, and find a way to give
back 45 or 95 dollars under the table: on one side the illusion is maintained that the price is
high and constant, on the other, one can happily strangle competition, by lowering prices only on
the competitive segment (the rebate is conditioned, of course, to stopping any sale of the rival
product).
The competition law
This wonderful monopolistic invention has one flaw, though: it brutally violates the rules of
competition, which are codified, for better or worse, in almost all countries, including
Argentina. To function properly, it must be carried out in the greatest secrecy, and stay safe
from prying eyes.
But it may well be that this discretion is not going to las much longer: using the laws on
competition in Argentina, Pixart filed appeal, describing what it thinks is the strategy followed
by Microsoft, and asking the judge to compel Microsoft, and distributors to provide all evidence
of purchases, grants, rebates, in short, an account of all financial transaction, even by means
of intermediaries, between Microsoft and distributors.
Pixart also suggests that the judge checks whether Microsoft properly pays tariffs for imports of
these licenses: it is well known that Microsoft

There have been plenty of efforts to try to curb "cyberbullying," often through laws that try to
make it illegal to be a
jerk. Unfortunately, the concept of cyberbullying is so vague that this creates
tremendous problems and unintended consequences. And, on the whole, it seemed unlikely that any
such law could withstand First Amendment scrutiny. However, it appears that the First Amendment
isn't always the First Amendment we thought it was.
A California appeals court has ruled that cyberbullying threats are not protected free speech. Now, you can
understand why people might like this conceptually. No one likes a bully. But making it against the
law to bully is incredibly risky, and almost certainly leads to a very different kind of
bullying.
In this particular case, a kid set up a website about himself, and his fellow students posted
comments mocking him. It was cruel, though you would think that the simple response would be to
take down those comments. Instead, the family went to the police -- who said that the comments "did
not meet the criteria for criminal prosecution and were protected speech." The family followed by
suing six students and their parents for hate crimes, defamation and intentional
infliction of emotional distress.
Now, there's no doubt at all that the comments were over the line and incredibly mean. However, it
looks like there was a perfectly reasonable process outside of the courts to handle this.
Apparently, the father of one kid who made some of the worst comments made his son apologize,
grounded him and took away his internet access. It seems that wasn't enough. Those who were sued
filed an anti-SLAPP motion under California's anti-SLAPP law (one of the strongest in the country),
but the judges said that the text was not protected free speech and thus did not fall under the
anti-SLAPP provisions. One of the kids, while admitting his own conduct was over the line, said he
was just joking around, and trying to top others in responding to the website. The judges, clearly,
did not find the joking to be funny. Indeed, it was not funny, but that doesn't mean you should
lose your free speech rights.
One judge dissented and argued strongly that not only was this a mistake, but it would have serious
First Amendment consequences: I share with the majority the view that R.R.'s post, like many
that preceded and followed it, was vulgar, nasty, offensive, and disgusting. But, as Justice Harlan
wrote in Cohen v. California... although --the immediate consequence of [free speech rights] may
often appear to be only verbal tumult, discord, and even offensive utterance[,] . . . [w]e cannot
lose sight of the fact that, in what otherwise might seem a trifling and annoying instance of
individual distasteful abuse of a privilege, these fundamental societal values [of freedom of
speech] are truly implicated.
In concluding that the post was not in connection with an issue of public interest, the majority
fails to follow relevant precedent and ignores the substantial evidence that D.C. was a person in
the public eye. The majority also creates a broad and groundless exception to the protections of
the anti-SLAPP statute, holding that for purposes of the statute, jokes do not constitute
communications in connection with issues of public interest.... That is not the law. It also
notes that while the "threats" in questions did seem incredibly distasteful, in context with all
the other comments, it seems obvious that they were not real threats: Reading the sequence of
posts from beginning to end, no reasonable person would foresee that any of it would be taken as a
serious threat of violence. No reasonable person would believe that (at least) four people were
sincerely threatening to take D.C.'s life. Taken together, all of the posts amount to nothing but a
lot of adolescent sex-obsessed hyperbolic derision, sarcasm, and repulsive foolishness In
fact, the judge notes that the kid who set up the website didn't seem bothered by the comments, and
was apparently more traumatized by his father filing this lawsuit. Maybe the kid should
sue his father?
